1. Acceptance of Terms

By accessing or using the website radyannaSuvar.shop ("Website") or engaging the services of RadyannaSuvar Pvt Ltd ("RadyannaSuvar," "we," "us," "our"), you ("Client," "you," "your") agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our Website or engage our services. These terms constitute a legally binding agreement between you and RadyannaSuvar.

2. About RadyannaSuvar

RadyannaSuvar Pvt Ltd is a proprietorship firm owned and operated by Rady Rajesh M. Anna, registered in Chennai, Tamil Nadu, India. We specialise exclusively in wall painting and wall design services for residential, commercial, and institutional properties in Chennai and surrounding areas. We do not provide wallpaper installation, waterproofing, plumbing, electrical work, carpentry, or any other home improvement services beyond our stated specialisation.

3. Eligibility

You must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872, to engage our services. By placing an order or booking a service, you represent and warrant that you are the property owner or have authorisation from the property owner to commission painting or design work.

4. Services Offered

4.1 Wall Painting Services

Our wall painting services include interior painting, exterior painting, apartment painting, villa and bungalow painting, office and commercial painting, colour consultation, surface preparation (putty, primer, sanding), and application of premium emulsions, distempers, and weather-shield coatings.

4.2 Wall Design Services

Our wall design services include texture painting, accent wall creation, geometric pattern design, artistic murals, 3D wall effects, ombre gradients, stencil work, and custom artistic wall treatments.

4.3 Service Limitations

We reserve the right to decline any project that falls outside our expertise, involves unsafe working conditions, requires work on structurally unsound surfaces, or conflicts with our professional standards.

5. Quotations and Pricing

  • All quotations are provided after a thorough site assessment (physical or virtual via photographs/video call).
  • Quotations are valid for 15 calendar days from the date of issue unless otherwise stated in writing.
  • Prices are quoted in Indian Rupees (INR) and are inclusive of labour, standard materials, and applicable taxes unless explicitly stated otherwise.
  • Additional costs may arise due to: unforeseen surface damage requiring extra preparation, client-requested changes to scope after work begins, premium or imported materials specifically requested by the client, or access difficulties requiring special equipment.
  • Any variation exceeding 10% of the original quotation will be communicated to you for approval before proceeding.
  • We reserve the right to revise pricing if material costs increase significantly between quotation and execution dates.

6. Booking and Confirmation

  • A booking is confirmed only upon receipt of the agreed advance payment (typically 30-50% of the total quoted amount).
  • Advance payment can be made via UPI, NEFT, RTGS, or cash (receipt will be provided).
  • Upon confirmation, we will provide a tentative start date and estimated completion timeline.
  • Scheduling is subject to team availability, weather conditions (for exterior work), and material procurement timelines.
  • We will communicate any changes to the agreed schedule at least 24 hours in advance, except in cases of emergency or force majeure.

7. Client Responsibilities

As our client, you agree to:

  • Provide accurate and complete information about the property, project requirements, and any known issues (dampness, leaks, previous paint problems).
  • Ensure unobstructed access to the work area on all scheduled working days.
  • Remove or secure fragile, valuable, or sentimental items from the work area before our team arrives. While we take precautions to protect furniture and belongings, we cannot be held responsible for pre-existing damage or items not disclosed to us.
  • Ensure availability of electricity and water at the work site as needed for our operations.
  • Provide adequate parking space for our service vehicle where applicable.
  • Make payments as per the agreed schedule without undue delay.
  • Communicate any concerns or change requests promptly and through designated channels.
  • Not engage or direct our team members independently outside the scope of the agreed project.

8. Execution and Timelines

  • Work will be carried out during standard working hours (9:00 AM to 6:00 PM, Monday to Saturday) unless otherwise agreed.
  • Timelines provided are estimates and may be affected by weather conditions, material availability, surface conditions discovered during work, or client-requested changes.
  • Delays caused by the client (e.g., restricted access, late decisions, payment delays) will extend the timeline proportionally.
  • We will keep you informed of progress through WhatsApp updates, photos, or in-person discussions as appropriate.

9. Quality and Workmanship Guarantee

  • We guarantee the quality of our workmanship for a period specified in your service agreement (typically 1 year for painting, 6 months for design work).
  • If any defect attributable to our workmanship (peeling, bubbling, uneven application) appears within the guarantee period, we will rectify it at no additional cost.
  • The guarantee does NOT cover damage caused by: water leaks or seepage, structural cracks or movement, impact or physical damage, exposure to chemicals or abrasives, natural disasters, or normal wear and tear.
  • Guarantee claims must be reported within 7 days of noticing the issue, with photographic evidence.
  • We will inspect the reported issue within 5 working days and schedule rectification within 15 working days if the claim is valid.

10. Intellectual Property

All content on this Website — including text, graphics, logos, images, design elements, and software — is the intellectual property of RadyannaSuvar Pvt Ltd and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission. Custom designs created for your project become your property upon full payment, but we retain the right to photograph and showcase the work in our portfolio unless you request otherwise in writing.

11. Limitation of Liability

  • Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific project in question.
  • We shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of profit, or loss of data.
  • We are not liable for delays or failures in performance resulting from force majeure events including natural disasters, pandemics, government orders, strikes, or material shortages beyond our control.
  • Colour appearance may vary slightly between digital previews and actual paint on walls due to lighting conditions, surface texture, and monitor calibration. Such variations are not considered defects.

12. Dispute Resolution

In the event of any dispute arising out of or in connection with these terms or our services:

  • Both parties shall first attempt to resolve the dispute amicably through direct negotiation within 15 days.
  • If unresolved, the dispute shall be referred to mediation under the Mediation Act, 2023.
  • If mediation fails, the dispute shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Chennai.
  • The language of arbitration shall be English.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

14. Indemnification

You agree to indemnify and hold harmless RadyannaSuvar Pvt Ltd, its proprietor, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these terms, misuse of our services, or violation of any applicable law.

15. Modification of Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Website or services after such changes constitutes acceptance of the modified terms. For active projects, the terms in effect at the time of booking shall apply unless both parties agree otherwise in writing.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, Service Policy, Payment Policy, and any written quotation or service agreement, constitute the entire agreement between you and RadyannaSuvar regarding the subject matter herein.
